Voluntary Disclosures
The Voluntary Disclosures Program grants relief on a case by case basis to taxpayers who voluntarily come forward to fix errors or omissions in their tax filings before the CRA understands or recognizes the error or omission and makes contact or takes punitive action. If a Voluntary Disclosures Program application is accepted by the Canada Revenue Agency, taxpayers will have to pay the taxes owing, plus interest, in part or in full. However, taxpayers would be eligible for relief from tax prosecution and, in some cases, from penalties that they would otherwise be subject to under the legislation.

Director Liability Assessments
In general, a Director Liability assessment is designed to hold a director personally responsible for the amount of trust funds owing to the Federal Government. With respect to Section 227 of the Income Tax Act, trust funds consist of source deductions taken from employees to be remitted to various government programs such as the Canadian Pension Plan and Employment Insurance. With respect to Section 323 of the Excise Tax Act, trust funds consist of unremitted or unpaid GST/HST taxes collected as a function of the company’s sales.
